Which Permit Do I need?
The SWPPP Coordinator ultimately will decide which permit you will need for your construction project. Each applicant should complete section 1 and 2 of the Land Disturbance Permit application to describe the size and nature of the project. You will use one of the permits described below for earth disturbance of more than 500 sq ft.
Acronyms:
Construction General Permit (CGP)
Common Plan Permit (CPP)
Notice of Intent (NOI)
Notice of Termination (NOT)
Storm Water Pollution Prevention Plan (SWPPP)
LDP
Disturbed areas under 500 sq ft do not require any permits.
Disturbed areas over 500 sq ft, but less than 1 acre that don’t require either NOI as described below, will require a completed LDP application only.
CGP
Disturbed areas greater than or equal to 1 acre will require a completed CGP NOI and CGP SWPPP. No LDP required.
Example: A subdivision in which each home is being installed by the same operator. OR any land disturbance greater than or equal to 1 acre.
CPP
Projects that intend to fulfill a common plan of development or sale that cumulatively disturbs greater than or equal to one acre will require a completed CPP NOI and CPP SWPPP. No LDP required.
Example: Single lots in a subdivision that together make up more than 1 acre, but each lot has a different operator. Each operator would need a CPP NOI.
