NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Orem.
REQUEST FOR RELEASE OF FUNDS
On or about August 6, 2026 the City of Orem will submit a request to the U.S. Department of Housing and Urban Development, Region VIII for the release of Orem City’s Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (42 U.S.C. 5301 et seq.), to undertake the following project:
Project Title: The Refuge Non-Congregate Shelter
Purpose: The Refuge Non-Congregate Shelter consists of an irregular-shaped parcel (66-977- 0203), approximately 4.03 acres that is located approximately 244 feet north of the northwest corner of North State Street & 800 North intersection. To the north of the subject property is residential housing, to the east is State Street and a multi-tenant commercial strip, to the south various businesses and to the west is 400 West and additional multi-tenant commercial retail spaces. The purpose of the project is to address the urgent need for more shelter space for domestic violence victims through the development of a new facility which includes a 120 bed non-congregate shelter facility with parking, a playground, storage units for residents, a childcare facility, and space for nine transitional apartment units.

Estimated Cost: The total development budget for this project is approximately $17,171,672.
Estimated HOME Investment Partnerships Program HUD funds for this project are roughly
$1,760,000 HOME-ARP from Provo City Corporation, and $45,113 from Orem City Community Development Block Grant (CDBG). This environmental review and Finding of No Significant Impact and Notice of Intent to Request Release of Funds is regarding the $45,113 of Orem CDBG funds allocated toward the overall project budget.
FINDING OF NO SIGNIFICANT IMPACT
The City of Orem has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Orem through email a [email protected], or through the submission form on the MAG website at magutah.gov/orem-cdbg-program. All comments received by 5:30 PM on August 5, 2026 will be considered by the City of Orem prior to authorizing submission of a request for release of funds. Comments should specify which notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of Orem certifies to the U.S. Department of Housing and Urban Development that Karen McCandless in her capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Orem to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the City of Orem’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Orem; (b) the City of Orem has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Samuel Potter, CPD Region VIII Director at [email protected].
